Terms of Service

These Terms of Service ("Terms") govern your use of EmberScripts ("the Service"), a creative writing platform operated by Osei Interactive ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
EmberScripts is an AI-powered writing studio that helps users create, manage, and publish fiction. Features include voice-driven authoring, AI-assisted scene generation, story management tools, and public sharing of creative works via wiki pages and published stories.
2. Eligibility
You must be at least 13 years old to create an account and use EmberScripts. Users under 16 may not access content rated "Mature" or "Explicit" by its author. By creating an account, you represent that you meet these age requirements.
3. Account Terms
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information when creating your account.
- You must not use the Service for any illegal purpose or in violation of these Terms.
- One person or legal entity may not maintain more than one account.
4. Credits and Payments
Core features of the Service are free to use. Hosted AI inference is paid for with credits. Credits, purchases, expiry, refunds, and discontinuation of the Service are governed by our Credits and Payments Policy, which is incorporated into these Terms by reference. Key commitments include a 500-credit signup bonus for new accounts, a 14-day refund window on purchases, a 12-month rolling expiry from the date of your last account activity, and at least 90 days' advance notice with a pro-rata refund of unused purchased credits if we discontinue the Service.
5. Content Ownership and License
5.1 Your Content
You retain full ownership of all creative content you produce using EmberScripts, including stories, characters, world-building materials, and any other works ("Your Content"). We do not claim ownership over Your Content.
5.2 License to EmberScripts
By making Your Content publicly available through the Service (e.g., via shared wiki pages, published stories, or shared scenes), you grant EmberScripts a non-exclusive, worldwide, royalty-free license to display, distribute, and cache that content solely for the purpose of operating and providing the Service. This license ends when you remove the content from public access or delete your account.
5.3 AI-Generated Content
Content generated or modified by the AI features of EmberScripts is provided as a creative tool. You are responsible for reviewing, editing, and approving all AI-generated content before publishing it. AI-generated content that you incorporate into Your Content becomes part of Your Content and is subject to the same terms.
6. Content Rating Obligations
When sharing or publishing content publicly, you must assign an accurate maturity rating to your story. The available ratings are:
- General — suitable for all audiences.
- Teen — may contain mild violence, infrequent strong language, or suggestive themes.
- Mature — contains violence, strong language, sexual themes, or other content not suitable for readers under 16.
- Explicit — contains graphic sexual content, extreme violence, or other adult material.
Deliberately mis-rating content to circumvent age restrictions is a violation of these Terms and may result in content removal or account suspension. This obligation exists in accordance with Article 197 of the Swiss Criminal Code, which prohibits making pornographic material accessible to persons under 16.
7. Prohibited Content
The following content is strictly prohibited on EmberScripts, regardless of context or artistic intent:
- Child sexual abuse material (CSAM) — any depiction of minors in sexual situations, including fictional or drawn depictions, in accordance with Article 197(4) and (5) of the Swiss Criminal Code (StGB).
- Incitement to violence or terrorism — content that promotes, incites, or provides instructions for real-world violence or acts of terrorism, per Articles 259 and 260 StGB.
- Doxxing and deanonymization — publishing private personal information (real names, addresses, phone numbers, etc.) of real persons without their consent, in violation of Swiss personality rights (Art. 28 ZGB) and data protection law.
- Incitement to hatred — content that incites hatred or discrimination against persons or groups on the basis of race, ethnicity, religion, sexual orientation, or gender identity, per Article 261bis StGB.
We reserve the right to remove prohibited content immediately and without notice. Repeated or egregious violations will result in account termination.
8. Notice and Takedown
If you believe content on EmberScripts violates these Terms or applicable law, you may report it using the reporting tools available on all public pages, or by contacting us at the address listed below. We will review all reports promptly and take appropriate action, which may include:
- Removing or disabling access to the reported content.
- Issuing a warning to the content author.
- Suspending or terminating the author's account.
We aim to acknowledge reports within 48 hours and to resolve them within 7 business days. The content author may appeal a takedown decision by contacting us in writing.
9. Termination
9.1 By You
You may delete your account at any time. Upon deletion, your private content will be removed from our active systems. Publicly shared content that has been cached or archived may persist until those caches expire. Treatment of any unused credit balance on voluntary deletion is set out in our Credits and Payments Policy.
9.2 By Us
We may suspend or terminate your account if you violate these Terms, particularly the Prohibited Content provisions. Where possible, we will provide notice before termination, except in cases involving illegal content, where immediate action may be required. Treatment of any credit balance on termination for cause is set out in our Credits and Payments Policy.
10. Limitation of Liability
To the maximum extent permitted by Swiss law (Article 100 of the Swiss Code of Obligations), EmberScripts is provided "as is" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
In no event shall EmberScripts be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or CHF 100, whichever is greater.
Nothing in these Terms excludes or limits liability for damages caused intentionally or through gross negligence (Art. 100 OR).
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with the Swiss Federal Act on Data Protection (nFADP).
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify registered users by email or through the Service. Continued use of the Service after such notification constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with Swiss law, excluding its conflict of laws provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at the registered office of EmberScripts, or, at the consumer's election, the courts at the consumer's domicile, in accordance with the Swiss Code of Civil Procedure.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
